Trucking and Commercial Vehicle Accidents

Confidential Settlement Prior to trial – Tractor-trailer Collision

The Plaintiff was side swiped by a semi-trailer truck while travelling on I-95 in northern Brevard County. The impact pushed the Plaintiff’s vehicle into the concrete retaining wall. She suffered a severe neck injury that ultimately resulted in cervical spine surgery. The trucking company refused to make a pre-suit offer and denied liability. It was argued that the Plaintiff actually swerved into the tractor-trailer. Attorney Derrick Connell filed a lawsuit against the truck driver and the trucking company. Through a bitter fought discovery process, Mr. Connell discovered numerous violations of the Federal Motor Carrier Safety Regulations. It was also discovered that the defendant driver did not keep proper logs as required by law. After revealing the malfeasance on the part of the defendant company and pushing hard toward trial, the defendants settled for a confidential amount.

Confidential Settlement – Bus Accident

The Plaintiff was traveling through a round-a-bout when a passenger bus failed to yield the right-of-way, impacting the driver side of the Plaintiff’s vehicle. Although not significant physical damage to the vehicles, the Plaintiff suffered significant injuries. She ultimately underwent spinal surgery after failed conservative treatment. The case was initially handled by another law firm and did not progress as the client would like. Once Attorney Derrick Connell became involved, he pushed hard toward trial – serving discovery, motions to compel and taking numerous depositions. Ultimately, the defendant corporation came to the table and put significant money out to settle the case.

Confidential Settlement – Tractor-trailer Collision

While stopped in a construction zone on a rural road, the Plaintiff’s vehicle was struck by a tractor-trailer. The impact thrust her vehicle into several others causing a multi-car, multi-fatality crash. It was estimated that the tractor-trailer was exceeding the speed limit and never applied his breaks prior to impact. Derrick Connell, working with both the defendant corporation and the lawyers representing the other Plaintiffs, was able to secure a very large (and confidential) settlement for the deceased’s estate. Additionally, Mr. Connell collected the Under-Insured Motorist coverage.

$187,500 – Tractor-trailer Collision

The client was stopping for traffic on I-95, just south of Eau Gallie Blvd, when the tractor-trailer rear-ended the vehicle behind her causing it to collide with her vehicle. For the first several days, the client did not realize that she was injured in the accident. The Plaintiff suffered a shoulder injury and back injury – these resulted in injection therapy. Initially, the insurance company argued that none of the injuries were related. Ultimately, Derrick Connell negotiated a settlement for $187,500.
